Unless otherwise indicated below, Power 93.5 KDGS’s general contest rules apply to Power 93.5 KDGS contests. For the specific terms and conditions applicable to a particular Power 93.5 KDGS contest, please see below.

Contest Rules:

HERE ARE SOME OF THE RULES FOR THE “Power 93.5 Kendrick Lamar Flyaway” CONTEST.  

NO PURCHASE NECESSARY.

You must be 18 or older to win. From April 16th to April 27th, 2018, there will be two (2) daily qualifiers. To qualify, you must be the 9th caller when we give the “Kendrick Lamar Flyaway” cue to call. We will have a total of 20 qualifiers. Each qualifier will be selected approximately at 7am, and 5pm. Each qualifier will win a Free Tempered Glass Protector from Mobilecomm. Each glass protector certificate has an approximate value of $15. One winner will be chosen from all qualifiers for the grand prize. The grand prize includes; one pair of tickets to the Kendrick Lamar Concert Friday, May 25th at the Lakewood Amphitheater in Atlanta, GA., one night’s hotel accommodations in Atlanta, GA, and a pair of round trip coach airfare tickets from Eisenhower National Airport in Wichita to Atlanta International Airport in Atlanta, GA. Contest Winner is responsible for all other cost, including ground transportation, and hotel incidental charges. In the event that the chosen winner declines the prize, then another person will be randomly selected as the winner. This prize cannot be substituted or exchanged for a different prize. The grand prize drawing will be Monday, April 30th at approximately 7am. The grand prize has an approximate value of $1,041.00. Once airfare travel has been purchased the winner cannot make changes to flight tickets. With exception of these material terms, general contest rules apply.

These contest rules are specific to the above contest conducted by Entercom Wichita, LLC d/b/a KDGS-FM (collectively, the “Station”).   Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well.  A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 9111 E. Douglas Suite 130 Wichita, KS 67207 during regular business hours and on the Station’s website at www.power935.com/rules.  To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest.

Entry/Winning
1.    NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST

2.    Listeners can enter the Contest by listening to the Station weekdays (Monday – Friday) (excluding holidays) between April 16th, 2018 and April 20th, 2018 at approximately 7:10am, 8:10am,3:35pm, and 5:20pm, each day for the Station on-air personality to play Power 93.5’s “Big Money Hi- Lo” sounder.  After the sounder is played, the 9th caller at 316-869-1093 will be given an opportunity to guess the cash amount of the jackpot.  (Calls to other numbers, including the Station’s general number will not be accepted.)  The 9th caller will have 10 (ten) seconds to guess the exact amount (dollars and cents) of the jackpot.  The on-air personality then will indicate whether the guess is too high, too low or the correct amount in the cash jackpot.  A prize will be awarded, upon confirmation of eligibility, to the 9th caller who guesses the correct amount (dollars and cents) in the jackpot within the allotted10 (ten) seconds and the contestant will win the jackpot amount (each a “Winner”).  Another game will begin and the Contest will continue until the sooner of: (i) the maximum amount of $848.53 in the aggregate has been awarded in this Contest; (ii) or until April 20th, 2018.  The maximum amount of all prizes awarded in this Contest is limited to $848.53.   WARNING:  Online listeners to streamed broadcasts may experience a lag in transmissions due to buffering limitations.  Contest Participants should not rely on streamed broadcasts. 

3.    The cash amount of each Jackpot will be pre-determined by Station prior to accepting any guesses.

4.    The odds of an entrant selecting a correct jackpot depend upon the number of contest plays for any particular jackpot amount and the number of prior contestants have already guessed on a particular jackpot.

5.    Up to 2 (2) prizes will be awarded in this Contest.  Cash prizes will be paid by company check and will be available within 8 weeks of Winner’s completion of all required Station documents and verification of eligibility.   The maximum amount of all prizes awarded in this Contest is limited to $848.53.

Each winner will win a pair of tickets to see Kevin Hart perform Thursday April 12th at Intrust Bank Arena at 500 E. Waterman Street, Wichita, KS. Contest Winner is responsible for all other cost, including ground transportation. In the event that the chosen winner declines the prize, then another person will be randomly selected as the winner. This prize cannot be substituted or exchanged for a different prize. Each pair of tickets has a total value of approximately $79.00. How to Enter

  1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE POWER 93.5 SUPER CAR KIDS CONTEST (the “Contest”).

 

  1. To enter between 12:00am (CT) on Monday, February 5, 2018 and 11:59pm (CT) on Friday December 14, 2018 (the “Contest Entry Period”), go to www.power935.com, click on the “Super Car Kids” graphical link (may be located on the Contest page), and complete and submit an online entry with your name, address, daytime and evening phone numbers (including area code), email address, age and an essay telling us, in 300 words or less, why YOUR child aged six (6) through seventeen (17) (i.e., must be at least six (6) years of age or older, but not yet 18 years old, on date of entry), deserves the “Super Car Kid Of The Week Us Smile” prize from Super Car Guys (“Sponsor”), and how they are excelling academically, athletically, or community service (the “Child Nominee”).
    1. ENTRANT MUST BE THE PARENT OR LEGAL GUARDIAN OF THE CHILD NOMINEE (“Entrant”).
    2. Essay should be three hundred (300) words or less.  Entries with an essay comprised of more than three hundred (300) words will not be disqualified, but only the first three hundred (300) words will be read and considered for the Contest.
    3. Essay should be truthful to the best of the Entrant’s knowledge.  However, Station will not verify the truthfulness of the information submitted in each entry; provided, however, that failure to satisfy (or suggestion that you fail to satisfy) the entry eligibility requirements or other contest rules applicable to this contest can result in disqualification of the entrant from becoming the weekly prize winner, in Station’s sole discretion.
    4. Station reserves the right, but is under no obligation, to edit an entrant’s essay in any manner that it chooses at Station’s sole discretion.
    5. The entry/registration process may require you to either log into an existing account, or create a free account with the game administrator, Second Street Media Inc. (“Second Street”).  You may either elect the option to have your Facebook profile pre-load applicable portions of the entry form (Facebook account is not required to enter this contest), or complete the online entry/registration form by submitting the Entrant’s full name, address of legal residence, phone number (including area code), age, username (subject to acceptance by contest software to eliminate duplicate usernames), password, e-mail address, and other information requested (some of which may be optional). 
    6. Limit one (1) Second Street account per email address.  Limit one (1) entry per Second Street account. 
    7. As part of the entry process, Entrants may be provided with an opportunity to opt-in to receive solicitations from, and/or to become a member/participate in clubs of (i.e., email clubs, text clubs, and rewards programs), the Station; provided, however, agreeing to receive such solicitations and/or accepting such membership is not a condition of entry into this contest and will not increase your chances of winning.

 

  1. By submitting an entry, Entrants affirm that the entry is original and does not contain any copyrighted, plagiarized or defamatory material and agree that Sponsors may read any entry submitted on the air (in whole or in part, edited or unedited) and use entries as the subject of commentary, humorous or otherwise.  By entering this contest, entrants waive any right to make any claim against Sponsors with respect to any disparaging or other comment made on-air about such entrant’s entry and hereby agrees to indemnify and hold Station and Sponsor harmless from any and all claims, demands, complaints, loss, damage or expenses (including without limitation reasonable attorney’s fees) resulting from the information/content contained in each Entrant’s entry about themselves, their Child Nominee or any other person mentioned or referenced therein (including, without limitation, if the information/content is communicated by Station or Sponsor verbatim or in any paraphrased form).  

 

  1. Both the entering parent/legal guardian and the child must be eligible to win in this contest (other than the minimum entry age restriction with respect to the child).

 

  1. By entering this contest, Entrants understand and agree that Station may elect to use any entry submitted for entertainment purposes on-air and may choose to comment on, mock, poke fun at, and/or mimic any entry submitted.  Entrants waive any right to make any claim against Station or any Sponsor with respect to any comments - disparaging or otherwise - made on-air regarding such Entrant’s entry. 

 

How to Win

  1. At approximately 9:00am (CT) on the last Thursday of each week from February 8, 2018 through December 20, 2018 (except for the week of November 19, 2018 in which case at approximately 9:00am (CT) on Wednesday November 21, 2018), Station judges will review and judge, based on any lawful criteria they deem desirable, all entries received in the Contest through the time of such review (excluding previous winners in this contest), and select one Entrant to receive the one (1) weekly prize for that week (as described in Section 10 below), subject to verification of eligibility and compliance with the Contest rules (each, a “Weekly Winner” and collectively, the “Weekly Winners”).  Station will announce the name of the Weekly Winner and their one (1) Child Nominee on the Station the following morning (i.e., Friday) at approximately 8:20am, and will post the names of the Weekly Winner and their Child Nominee online at www.power935.com.  Weekly Winners need not to listen to Station at the time of such announcement in order to win.  Station will attempt to contact the Weekly Winners by telephone based on the number provided in the submitted entry. 
    1. There will be up to, but no more than, forty-six (46) verified Weekly Winners in this Contest. 
    2. Weekly Winners may be asked, but will not be required to, provide the Station with a photo depicting either (i) such Weekly Winner’s Child Nominee ONLY or (ii) the Weekly Winner AND the Child Nominee.  The Station may, but will not be obligated to post any such submitted photo on its website and/or social media pages.  
      1. Entrant must exclusively own (or has obtained the a license from the copyright holder to) the copyright in the submitted photo (it cannot be “owned” in any way by any other person or company without obtaining his/her express consent to enter this contest and allow Station to use the photo as contemplated in the contest rules).
      2. Photo must not contain or convey any content that the Station determines at its sole discretion, subjectively or otherwise, (i) to be indecent, profane, obscene, explicitly sexual, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, libelous, or hateful, (ii) to be racially, ethnically, or otherwise offensive or objectionable, (iii) to encourage unlawful behavior, (iv) to contain, depict, or otherwise infringe upon the brand name(s), copyright(s), trademark(s), servicemark(s), tradename(s), logo(s), or any other intellectual property that may belong to a third party, or (v) to disclose any detailed personal, physical, contact, or otherwise confidential information that may belong to a third party.  The foregoing is not intended to require Station to disqualify entrants who, in Station’s sole discretion, appear to be innocently wearing clothing or are in areas that just happen to contain third party logo(s) or mark(s).  Further, Station may, but is not obligated to pixilate/cover any trademark(s), servicemark(s), tradename(s), and/or copyrighted materials in Station’s sole discretion.  Station shall not be required to make the same determination based on the foregoing for every photo and may treat each photo entry differently, in its sole discretion, even if the problematic content is similar.
      3. Entrant agrees and acknowledges that Station, all contest sponsors, and their respective affiliates, parents, employees, agents and all other related sponsors may use the name, image, photograph submission, other entry materials and/or biographical information of the Entrant and/or the Entrant’s child for advertising and/or promotional purposes on radio, TV broadcasts, in the newspaper, on websites and/or any other medium in connection with participation in this contest or otherwise without the payment of any additional compensation to the Entrant or to the Entrant’s Child Nominee.

 

  1. On or after December 21, 2018, Station staff and/or management will randomly select the potential one (1) grand prize winner in this Contest from among the up to forty-six (46) verified Weekly Winners to receive the one (1) grand prize in this Contest (as described in Section 11 below), subject to verification of eligibility and compliance with the Contest rules (the “Grand Prize Winner”).  Station will announce the name of both the one (1) Grand Prize Winner and the one runner-up of this Contest on January 4, 2019.  The potential Grand Prize need not be listening at the time of such announcement in order to win.  Station will contact the potential Grand Prize Winner.  Should the potential Grand Prize Winner not meet the eligibility requirements or is disqualified for any other reason, the Station may, but shall not be obligated to select, an alternate potential grand prize winner.  In the event such alternate grand prize winner does not meet eligibility requirements or is disqualified, Station shall not be obligated to make any additional alternate grand prize winner or selection, and in such event, no grand prize will be awarded in this Contest.

 

  1. PRIZES IN THIS CONTEST WILL ONLY BE AWARED TO ENTRANTS SELECTED AND VERIFIED AS A POTENTIAL WEEKLY WINNER AND/OR THE POTENTIAL GRAND PRIZE WINNER.  NO CHILD NOMINEE WILL BE ENTITLED TO WIN ANY PRIZES IN THIS CONTEST.    

 

  1. Odds of any Weekly Winner becoming the one (1) Grand Prize Winner in this Contest will be up to, but in no event more than, 1:46.

 

Prizes

  1. Each of the up to forty- verified Weekly Winners in this Contest will receive:
    1. one (1) pizza party for their Child Nominee’s class consisting of up to four (4) pizzas to be delivered to Child Nominee’s school on a date agreed upon by the Station and Weekly Winner in cooperation with Child Nominee’s school; and
    2. $100 in gift cards (i.e., one or more gift card totaling $100) issued by a major credit card or financial institution, subject to the terms and conditions of the company or institution issuing such gift card, which except to the extent required by law, may not be redeemed for cash and will not be replaced if lost stolen or damaged.

 

  1. The one (1) verified Grand Prize Winner in this Contest will receive $1000 in gift cards (i.e., one or more gift card totaling $1000) issued by a major credit card or financial institution, subject to the terms and conditions of the company or institution issuing such gift card, which except to the extent required by law, may not be redeemed for cash and will not be replaced if lost stolen or damaged.

 

  1. Super Car Guys will donate $1000 to the one (1) school in which the verified Grand Prize Winner’s Child Nominee is enrolled as student during the 2018-2019 school year (the “School”).  In the event that the School is unwilling or unable to sign or provide documentation required and/or accept the donation, then the School will not receive the donation and will not be entitled to any alternate prize or donation in this Contest.  Station and Sponsor have no obligation to the Grand Prize Winner regarding the application of the check funds by the School, which includes but is not limited to how the funds are used by the School and the timing of the distribution of the funds by the School.

Other Rules Specific to this Contest

  1. In order to receive any prize in this Contest, potential Weekly Winners and the potential Grand Prize Winner will be required to produce documentation (including but not limited to a birth certificate or court order appointing a legal guardian) establishing that (i) they are the parent or legal guardian of their Child Nominee; and (ii) the Child Nominee meets the age eligibility requirement set forth in Section 2 above.

 

  1. Second Street is not a sponsor of this contest but entrants may be required, as part of the entry process, to agree and consent to Second Street’s Terms of Service and Privacy Policy (both of which are available via a link during the contest entry process) (collectively, the “Second Street Policies”) and may be required to register with Second Street.  While agreement to the Second Street Policies is required in order to enter this contest, the Second Street Policies are not a part of these contest rules but are a separate agreement between the entrant and Second Street.  With respect to the conduct of this contest by Station, in the event of any conflict between the Second Street Policies and the Station contest rules, the Station’s contest rules govern.

 

  1. Station is not responsible for any error or technical malfunctions associated with the Second Street site that may affect any entrant’s ability to enter, win, or be properly considered in this Contest, regardless of the cause. In the event of a malfunction associated with the Second Street site that Station (in its sole discretion) deems to materially and adversely affect this Contest, Station reserves the right to suspend this contest, terminate this contest without a winner, terminate this contest and select a winner early, provide alternative means of entry or any other changes to these contest rules that Station deems appropriate under the circumstances. Any such changes, terminations or suspensions will be announced on air and/or posted on the Station’s website, if applicable.
